Terms of Use
THE AGREEMENT: This document constitutes the entire agreement between Audio Description Training Retreats, LLC ("ADTR") and the Student for the purchase of an online training regarding the craft of Audio Description (AD). The course offers pre-recorded and live presentations paired with live Q&A sessions with direct advice from Colleen Connor, other experts, guest speakers or professionals on implementing the information participants will learn in the handouts, curriculum, discussions, and peer practice.
- AN ACCOUNT with Thinkific must be created to take part in ADTR trainings. In registering on the platform, the Student must choose a password and may be asked for additional information. The Student is responsible for maintaining the confidentiality of their password and account information, and is fully responsible for all activities that occur under their password or account. You agree to (a) immediately notify ADTR of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you log out of your account at the end of each session. You may never use another user's account without ADTR's prior authorization. ADTR will not be liable for any loss or damage arising from your failure to comply with this agreement.
- ADTR reserves the right to terminate your account or your access to the course immediately, with or without notice, and without liability to you, if ADTR believes that you have breached any of the Agreement terms or conducted yourself in a way that is inappropriate by law or warning. Also, accounts can be terminated based on providing ADTR with false or misleading information, or interfered with the use of the platform.
- PROVIDING AN EMAIL address to ADTR, you agree that we may use your email address to send you notices about the course as well as communicate with you. We may also use your email address to alert you to changes, send you assignments or feedback, recommend things, indicate enrollment status, request surveys, and send primary links to registrations or training meetings etc. Your email will go into our Student area and you will receive updates and other ADTR news. If you do not wish to receive emails after you have completed a training—you can opt out by selecting the "unsubscribe" link within ADTR announcements and fill out your preference form. Opting out may prevent you from receiving emails about updates, news, networking, job information, and special content.
- RESULTS are not guaranteed by any ADTR instructor or contractor. Students are encouraged to actively participate in trainings. The success or failure of the sessions is determined by the dedication of the Students, the dynamics developed throughout the training, and the resources provided. ADTR is not responsible for adverse outcomes due to lack of Student engagement, negative peer interactions, perceived talent, or disuse of course developments.
- The content and resources available through ADTR trainings are for educational purposes only. By purchasing and accessing the course, the Student agrees to assume full responsibility for any harm or damage suffered as a result of their use or non-use of the information and content available. The expectation is for the Student to exercise their judgement and due diligence before taking any action or applying any technique or advice suggested or recommended through the training and sessions.
- By accessing and purchasing the course, The Student accepts personal responsibility for the results of their use of the information available in the content. You agree that ADTR has not guaranteed the results of any action, advised or not advised by the content available in the trainings. The Student acknowledges that their ultimate success or failure will be the result of their own efforts, their particular situation, and a number of other circumstances beyond the control of ADTR.
- PAYMENTS Payments must be made according to the payment plan and payment deadlines.
- In the event that ADTR does not receive any of the payments included in the payment plan from the Student (including if a card is declined), access to the course and the resources available in the course will be cancelled until the Student or their sponsor makes the corresponding payments. In the event of late payments or failure to pay, ADTR is entitled to declare the remaining amount due and payable, and reserves the right to pursue further collection service or legal action.
- Payments for the course, including partial payments made according to the payment plan, are not refundable, even if access to the course is cancelled due to non-payment. Payments may be transferable to other trainings in extenuating circumstances, with proper notice, at the discretion of ADTR.
- This agreement is binding, and failure to meet its terms will result in certain recourse.
- ANY DISPUTES or complex situations arising from the object and obligations of this contract shall be settled to the extent possible through negotiation and conciliation between the parties, for which a period of thirty (30) calendar days shall be allowed. However, at any time the parties may bring any dispute or controversy or claim related to this contract, including the existence, validity or termination thereof, before an Arbitral Tribunal. The costs of arbitration proceedings shall be those stipulated by the parties. However, each party to the dispute shall bear its own expenses, including attorneys' fees. The parties retain the right to bring an individual action or claim in a court of competent jurisdiction.
- THE LAW AND JURISDICTION that this Agreement is governed by is the USA laws. Compliance with this Agreement is subject to existing laws and legal process.
This Agreement shall be binding upon the Parties and their respective heirs, successors, and assigns. The provisions of this Agreement are severable. If any provision is held to be invalid or unenforceable, it shall not affect the validity or enforceability of any other provision. The section headings are for reference purposes only and shall not otherwise affect the meaning, construction, or interpretation of ay provision of this Agreement. This Agreement constitutes the entire agreement between the Parties and supersedes any and all prior oral or written agreements or understandings between the Parties concerning the subject matter of this Agreement.
